Terms & Liability Release
ATTENTION: Please read this document before signing or accepting it as part of the checkout process. By accepting these terms, you acknowledge that you understand and agree to be bound by them.
In consideration for being permitted to participate in activities connected with Zejek Sportfishing, including fishing charters, boating, sightseeing, snorkeling when offered, and related activities, I voluntarily agree to this Terms & Liability Release.
1. Assumption of Risk
I understand that boating, fishing and water activities involve inherent risks, hazards and dangers, including changing sea and weather conditions, vessel movement, slips and falls, fishing tackle and hooks, marine life, seasickness, injury, property loss, and other risks that cannot be completely eliminated. I voluntarily assume the ordinary and inherent risks associated with participation.
2. Safety & Captain's Authority
I agree to follow the captain and crew's safety instructions. The captain has final authority concerning navigation, departure, return, fishing location, fishing method, weather and sea conditions, and any operational decision reasonably made for safety or legal compliance. A trip may be changed, delayed, shortened, rescheduled or cancelled when conditions or operational circumstances require it.
3. Fishing Results
I understand that this is fishing, not catching. Fish availability and fishing success depend on natural conditions and cannot be guaranteed. No particular species, size, number of fish or catch is promised.
4. Release of Liability
To the fullest extent permitted by applicable law, I release and hold harmless Zejek Sportfishing, the vessel owner, captain, crew and their agents from claims arising from the ordinary and inherent risks of the activity or my own actions. Nothing in this agreement is intended to waive rights or liabilities that cannot legally be waived.
5. Personal Responsibility
I am responsible for disclosing relevant limitations that may affect safe participation, supervising minors in my party, using provided safety equipment as directed, and protecting my personal property. I understand that alcohol consumption can increase risk and that unsafe or disruptive behavior may result in termination of participation.
6. Cancellation & Refund Policy
72 hours or more before departure: Cancellations made at least 72 hours before the scheduled departure time are eligible for a full refund of the reservation payment.
Less than 72 hours before departure: Cancellations made less than 72 hours before the scheduled departure time are non-refundable. The reservation payment/deposit is forfeited. A no-show is non-refundable.
7. Trip Already Started & Guest-Related Early Return
Once the vessel has departed the dock and the trip has begun, no refund, partial refund, or credit will be provided when the trip is shortened or terminated because of a guest-related circumstance. This includes, without limitation, seasickness, illness, discomfort, intoxication, unsafe or inappropriate behavior, inability or refusal to follow the Captain’s safety instructions, dissatisfaction, personal circumstances, a guest requesting an early return, or any other circumstance in which the Captain determines that a guest is unable to safely continue the trip.
The Captain has final authority to terminate or shorten a trip when, in the Captain’s judgment, a guest-related condition or conduct makes continuing the trip unsafe or inappropriate. A Captain-directed return for a guest-related reason does not create a right to a refund, partial refund, or credit.
8. Weather & Sea Conditions
The Captain has final authority regarding weather and sea conditions. If the Captain cancels a trip before departure because weather or sea conditions are unsafe, or significantly shortens a trip after departure because conditions become unsafe, a reasonable refund, partial refund, credit, or rescheduling option may be offered depending on the circumstances and the portion of the trip completed.
9. Electronic Acceptance
Checking the acceptance box during checkout constitutes my electronic acceptance of these Terms & Liability Release and the Cancellation & Refund Policy. I confirm that I have had the opportunity to read this document before payment.
